Terms of Use

1. Agreement

These Terms of Use (“Terms”) are an agreement between you and MELBMARKETING PTY LTD (ABN 98 690 946 055), the operator of LeafLulu. By downloading or using LeafLulu, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the app.

If you use LeafLulu on behalf of an organisation, you confirm that you have authority to accept these Terms for it. If you are not legally able to enter an agreement yourself, a parent or legal guardian must review and accept these Terms for you.

2. What LeafLulu 1.0 provides

The first store release provides on-device features including:

• plant setup, general care steps, daily observations, and notes;
• a private photo journal and growth-story tools;
• local care reminders, challenges, badges, streaks, Growth points, and Care score;
• a supplies-planning guide; and
• optional system sharing of a locally generated card or text.

Version 1.0 has no account, cloud sync, public community, direct messaging, checkout, subscription, paid virtual currency, live AI analysis, or hardware control. The supplies guide is a planning tool: it does not display sale prices, place orders, process payment, promise stock, or arrange delivery.

3. Licence and acceptable use

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use LeafLulu for lawful personal or internal business purposes, subject to these Terms and the rules of the platform from which you obtained it.

You must not:

• use the app unlawfully or to harm another person, animal, property, device, or service;
• attempt to bypass security, disrupt the app, introduce malicious code, or gain unauthorised access;
• reverse engineer, copy, redistribute, resell, or exploit the app except where applicable law expressly permits it; or
• misrepresent LeafLulu guidance or progress as a professional diagnosis, certification, financial value, or guaranteed outcome.

4. Plant-care guidance and safety

LeafLulu provides general educational guidance based on the information recorded in the app. Plants respond differently to local light, temperature, humidity, water, drainage, pests, soil, season, and handling. We do not guarantee germination, survival, flowering, yield, harvest timing, pest control, or a particular result.

Observe the real plant and growing conditions before acting. Do not water solely because a task or reminder appears. Confirm actual soil moisture and drainage first. Reminders may be delayed, suppressed, duplicated, or unavailable because of device settings, battery management, time-zone changes, operating-system behaviour, or permissions.

5. Your photos and content

You retain your rights in photos, notes, nicknames, and other content you create. You are responsible for having the right to use and share that content. Avoid photographing confidential workplace material, other people without permission, personal documents, computer screens, or sensitive location information.

LeafLulu 1.0 stores this content locally and does not upload it to us. If you choose a destination through the system share sheet, your relationship with that destination is governed by its terms and privacy practices.

6. Growth points, Care score, challenges, and streaks

Growth points are a once-per-day progress reward for completing the day’s care and real-photo check-in. Care score is a separate achievement total calculated from meaningful plant-day records, fixed photo milestones, and completed challenges. Both are local motivational features. They cannot be bought, sold, gifted, transferred, redeemed, withdrawn, exchanged with each other, exchanged for goods, or converted into money. They do not create property, payment, prize, or stored-value rights. We may correct, rebalance, or discontinue these features when reasonably required, subject to applicable law.

Sharing is optional and never changes Growth points or Care score. Do not perform unnecessary watering or unsafe care merely to advance a task, score, or streak.

7. Platforms and third-party services

Your device platform, app store, backup provider, and any app you choose from the system share sheet are independent services. Their own terms, privacy practices, availability, and charges may apply. We are not responsible for third-party services we do not control, but nothing in these Terms excludes responsibility that cannot lawfully be excluded.

If you downloaded LeafLulu through Apple's App Store, Apple is not responsible for providing maintenance or support for the app except as required by applicable law or platform terms. Support requests should be sent to us through the LeafLulu Support page.

8. Our intellectual property

LeafLulu, including its software, original artwork, interface, text, branding, sounds, and other materials, is owned by or licensed to us and is protected by applicable intellectual-property laws. These Terms give you permission to use the app; they do not transfer ownership of it or our branding to you.

9. Updates and availability

We may update, improve, suspend, or discontinue all or part of LeafLulu. We do not promise uninterrupted, error-free, or permanent availability. Updates may be needed for compatibility, safety, legal, or security reasons. We will not knowingly describe an unavailable online service as active in the store release.

10. Consumer rights, disclaimers, and liability

Nothing in these Terms excludes, restricts, or modifies a guarantee, right, remedy, or liability that cannot lawfully be excluded, including rights that may apply under the Australian Consumer Law.

To the maximum extent permitted by law, LeafLulu is provided “as is” and “as available”. We do not make guarantees beyond those expressly required by law. To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential loss arising from use of or inability to use the app, including plant loss, crop loss, missed reminders, or loss caused by acting without checking actual growing conditions.

11. Ending use

You may stop using LeafLulu and uninstall it at any time. You can first clear local data from the Me screen. Your platform may retain device backups according to your account and system settings. Your licence under these Terms ends if you materially breach them, subject to any rights you have under applicable law.

12. Governing law

These Terms are governed by the laws of Victoria, Australia. Courts with jurisdiction in Victoria may hear disputes, subject always to any mandatory consumer law or right to bring a claim in another forum that applies to you.

13. Changes and contact

We may update these Terms to reflect changes in LeafLulu or applicable law. We will publish revised Terms here and update the effective date. Your continued use after an update means you accept the revised Terms to the extent permitted by law.
